Litigation
Real Estate Litigation
Working closely with our highly respected Real Estate and Bankruptcy departments, we have developed a strong practice in litigation involving real estate interests. We have a great deal of experience addressing questions relating to the valuation, taxation, use, leasing, zoning, and encumbrance of real estate, as well as specific performance of contracts, foreclosures, condemnation actions, defending against foreclosures, and deficiency judgment actions. We also regularly represent both landlords and tenants in litigation of commercial lease disputes.
We successfully represented owners of residential condominium units at Two Liberty Place, a landmark structure in Center City Philadelphia, in defeating a proposal by a major corporate tenant for exterior facade signage. Our representation included an extensive presentation before the Philadelphia Zoning Board of Adjustment as well as litigation in the U.S. District Court for the Eastern District of the Pennsylvania and Philadelphia Court of Common Pleas.
In addition, we currently represent a nationwide mortgage institution in numerous matters including one in which it is a defendant in a suit filed by homeowners who had been defrauded by a mortgage broker’s Ponzi scheme. Our representation of the client includes defending actions currently pending in the Third Circuit Court of Appeals and the U.S. Bankruptcy Court for the Eastern District of Pennsylvania.
We also have represented several national law firms against claims of malpractice arising out of underlying real estate transactions.
Other recent successes include representing a health care network in obtaining township approval of zoning changes to facilitate the construction of a state-of-the-art hospital in the face of legal challenges funded by a competitor; representing a small community hospital in two levels of zoning board appeals to trial and appellate courts, preventing the construction of a large convenience store directly adjacent to the hospital’s emergency room entrance; and successfully handling cutting-edge litigation involving a building owner’s responsibility to provide special terrorism insurance on a high-rise office tower.
