Class Act(ion)

We represented a software company that was sued along with several other companies in a New Jersey state class action, on the grounds that the terms of a rebate were allegedly hidden under shrink wrap.  After initially winning a motion to quash service on our client's German parent company, we and the client recognized that an efficient settlement was in the client's best interests.  Before discovery even began, we were able to turn this state case into a national class settlement, which the New Jersey Superior Court approved, thus securing a release nationwide and averting the possibility of copycat suits across the nation.  It may be unusual for us to tout a settlement on our website, but in this case, the outcome was highly efficient, litigation costs were contained, the client was satisfied with the settlement numbers, and the settlement provided needed protection for the company from further litigation.  Wendy Beetlestone, Alva Mather, and Dan Segal handled the case.
