Total Victory in Multi-Million Dollar Binding Arbitration
We recently successfully defended one of the firm’s software development clients and two of its officers in binding arbitration against claims brought by one of the client’s former resellers. The reseller sought millions of dollars in damages against the client and two officers under a host of legal theories. After persuading the arbitrator to include the opportunity for dispositive motions in the arbitration scheduling order, we pursued discovery and then filed for summary judgment. The arbitrator granted the summary judgment motion, in part. We then defended the client and the officers against the remaining claims during a two-week hearing, after which the arbitrator ruled in favor of the client and officers on each remaining count, issuing a nineteen-page opinion in support of the complete victory entered in favor of the client and its officers.
