We have a significant litigation practice representing insurers, hospitals, vendors, practice groups and individuals regarding a wide variety of healthcare issues, including those relating to reimbursement and those flowing from sales and acquisitions of assets, vendor agreements, and employment decisions. We represent managed care and health maintenance organizations in cases brought by healthcare providers alleging improper claims processing or payment procedures. We have also guided healthcare providers through the legal issues created by changes in the healthcare system, such as managed care and vertical and horizontal consolidation. Our healthcare litigators, many of whom practice both civil and white collar criminal defense, have also represented healthcare clients in parallel criminal and civil proceedings.

We have also provided a wide range of advice to healthcare clients on issues concerning home healthcare, fraud and abuse, reimbursement, hospital privileges, antitrust, affiliation agreements and other contractual arrangements between healthcare facilities and between healthcare owners and managers. We successfully defended healthcare providers in a suit brought by two physicians to enjoin the reconfiguration of services at two physical facilities. We also successfully defended a public company contractor to nursing homes in criminal and civil proceedings brought by the United States Attorney’s Office. We secured the dismissal of fraud and conspiracy claims brought against our client, the CFO of a group of hospitals and nursing homes, by a terminated supplier of rehabilitation services. We also represented one of the region's largest providers of home health services in a civil RICO and antitrust action brought by a competitor. The firm also regularly advises hospitals and physicians on staff privileges.
