On June 14, 2017, the Commonwealth Court of Pennsylvania affirmed the trial court’s complete dismissal of a high-profile challenge to the Philadelphia Beverage Tax. The measure generates crucial revenues for the City of Philadelphia to fund thousands of seats for universal pre-kindergarten and critical improvements to community and recreation centers, among other important uses. The tax and its ensuing litigation have been the subject of extensive media coverage and national interest. The tax’s challengers have petitioned the Pennsylvania Supreme Court for allowance to appeal the Commonwealth Court’s decision.
