Hangley Aronchick recently prevailed before the US Court of Appeals for the Eighth Circuit in the matter of UnitedHealth Group, Inc. v. Columbia Casualty Co., et al. Ron Schiller served as lead trial and appellate attorney in the matter, and he and his team represented insurers Executive Risk Specialty Insurance Company and First Specialty Insurance Corporation—both part of a professional liability insurance tower issued to plaintiff UnitedHealth Group, Inc.—in this complex coverage action in which UnitedHealth sought hundreds of millions of dollars in coverage. In December 2014, the Hangley Aronchick team prevailed on summary judgement; UnitedHealth appealed. On September 7, 2017, the Eighth Circuit affirmed our summary judgment victory on all points. In addition to prevailing in a significant and hotly contested case, the opinion sets important and clear precedent for our clients on the issue of allocation between covered and non-covered claims, which is an area in need of clarification.
