On May 25, 2023, the United States Supreme Court issued its decision in Sackett v EPA, finding that federal protection of wetlands encompasses only those that directly adjoin rivers, lakes and other bodies of water. Environmental Group chair Steve Miano spoke with WHYY about possible implactions for wetlands in Pennsylvania and New Jersey. He noted that the defintions of wetlands are broader in both states, and that in Pennsylvania, “If the area is inundated by surface or groundwater, and supports a certain type of vegetation that’s typically in wet areas, then it’s defined as being a wetland.”
