Shareholder Andrew Erdlen spoke with the New Jersey Law Journal about the state attorney general’s recently released guidance for preventing discrimination in school discipline. The document, authored by Attorney General Attorney General Matthew J. Platkin and the acting Department of Education Commissioner Dr. Angelica Allen-McMillan, came as a response to a 2020 study that revealed disparities in school discipline based on protected characteristics under the New Jersey Law Against Discrimination. Andrew observed that “…what we are seeing here is a clear policy imperative by the Attorney General’s Office, the DCR, and the DOE to reduce the incidence of unlawful discrimination in schools,” and also discussed some of the legal theories supporting the new guidelines.
